AGF Condemns Edo Assembly’s Suspension Of LG Chairpersons

The Attorney General of the Federation, Lateef Fagbemi, has voiced his objections to the suspension of the chairpersons of all 18 Local Government Areas in Edo State, a decision made by the State House of Assembly.

Fagbemi challenged the move, asserting that it undermines the principles of good governance and questioning whether it complies with the laws that safeguard local government autonomy.

In a briefing with journalists in Abuja on Thursday, the minister pointed out that it is within the purview of the legislative arm of local governments to suspend or remove council chairmen. This statement highlights the constitutional framework that governs local government actions and the need for due process in any such decision.

He explained that, under the present system, no governor has the authority to arbitrarily remove or suspend local government chairmen without first adhering to the established legal process. This reinforces the importance of upholding the rule of law and due process in all matters of governance.

Fagbemi stated that state houses of assembly lack the power to suspend or remove council chairpersons.

On Tuesday, the Edo State House of Assembly suspended the chairpersons and their deputies for two months over alleged gross misconduct.

The Speaker of the House, Blessing Agbebaku, said Edo State Governor, Monday Okpebholo, had written a petition to the assembly regarding the chairpersons’ refusal to submit the financial records of their councils to the state government.
